These terms cover the use of this website and the services Photolicious provides. Please read them before engaging us. Where we sign a separate proposal, quotation or production agreement with you, that document takes precedence over these terms if the two conflict.

2. Using this website

You may browse this site and share links to it. You may not copy, download, scrape, republish or use any image, film, text or design from it without our written permission. Everything on this site is our property or is used with permission, and the images are the work we sell.

We keep the site accurate and current, but we do not promise it will be uninterrupted or error-free, and we may change or remove content at any time.

3. Enquiries, quotations and booking

  • Nothing on this website is a binding offer. Prices depend on scope, and we quote per project.
  • A quotation is valid for 30 days from its date unless it says otherwise.
  • A booking is confirmed when you accept the quotation in writing and pay any deposit stated in it. Dates are held only once confirmed.
  • Our fees, what is included, and any expenses recharged to you are set out in the quotation. Applicable VAT is added at the prevailing rate.

4. Changes, postponement and cancellation

  • If you change the scope after booking, we will confirm the effect on the fee and the schedule in writing before proceeding.
  • Postponements are subject to our availability. Costs already committed to third parties, such as crew, studio hire, talent or props, remain payable.
  • Cancellation terms, including any non-refundable deposit, are set out in the quotation for each project.
  • If circumstances outside either party’s reasonable control prevent a shoot — including weather, illness, permit refusal or restrictions imposed by an authority — we will reschedule in good faith rather than treat it as a breach.

5. What we need from you

To deliver on time we need timely briefs, approvals and feedback, access to locations, and the products or dishes to be shot in a usable condition. Where you supply talent, staff, customers, locations, recipes, branding or third-party products, you confirm to us that you have the rights and permissions needed for us to photograph and film them, including written releases from identifiable people.

6. Delivery and revisions

  • We deliver selected, edited images and cuts in the formats agreed in the quotation.
  • The number of included revision rounds is stated in the quotation. Further rounds are chargeable.
  • Raw or unedited files are part of our working process and are not delivered as standard. If you need them, ask before the shoot so we can price it.
  • We archive delivered work for [12] months as a courtesy. Please keep your own backup; we do not guarantee archive availability beyond that period.

7. Intellectual property and licensing

This is the part that matters most, so we have kept it explicit.

  • Ownership. Copyright in all photographs and footage we produce remains with Photolicious. We do not transfer copyright unless we agree to assign it in writing and the assignment is priced separately.
  • Your licence. On full payment, we grant you a licence to use the delivered material for the purposes, media, territory and duration set out in the quotation. If the quotation does not limit these, the licence is for your own marketing and commercial use, worldwide, with no time limit.
  • What the licence does not include. Resale, sub-licensing or transfer of the material to another business, and use by a third party such as a platform, distributor or franchisee, unless the quotation says so.
  • Before payment. No licence is granted until we have been paid in full. Material shared for review is for internal approval only.
  • Editing. Please do not materially alter, recolour or crop delivered work in a way that misrepresents it. Ask us and we will usually do it for you.
  • Our portfolio. We may show work we produce in our portfolio, on our website and on our social channels, and enter it for awards, unless you ask us in writing to keep a project confidential. We will honour a reasonable embargo before a campaign goes live.
  • Onward use by people appearing in the work. Unless we agree otherwise in writing, a person who appears in our material may not license, publish or exploit it themselves, and neither may the entity they represent. This displaces the default position that would otherwise apply under UAE copyright law.
  • Credit. We appreciate a credit where the format allows, but it is not a condition of your licence.

8. Third-party brands and content

Where a shoot features products, packaging or branding belonging to someone else, you are responsible for having the right to feature them. Do not ask us to compose material in a way that suggests an endorsement that does not exist.

9. Payment

  • Invoices are payable within the period stated on them, and by default within 14 days of the invoice date.
  • We may pause work or withhold delivery on overdue accounts, having given you notice first.
  • Invoices are issued in accordance with UAE invoicing requirements.

10. Confidentiality

We keep your unreleased products, recipes, campaign plans and commercial information confidential, and we expect the same of any crew we engage. We will sign your non-disclosure agreement on request.

11. Liability

We take responsibility for our work. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under UAE law, including under the UAE Consumer Protection Law and the Civil Transactions Law. Any term that would have that effect does not apply.

Subject to that, and except in cases of fraud, gross negligence or wilful misconduct:

  • Our total liability arising out of a project is limited to the fees paid to us for that project.
  • We are not liable for indirect or consequential loss, such as lost profits or lost business opportunity.
  • We are not liable for delays or failures caused by circumstances outside our reasonable control.

If something goes wrong with the material we deliver, tell us within 14 days of delivery so we can put it right.

12. Complaints

If you are unhappy with anything, email management@photolicious.ae with the details. We will acknowledge within two working days and give you a considered response within ten working days. You retain any right you have to raise the matter with the relevant UAE authority.

13. Privacy

How we handle personal data is set out in our Privacy Policy, which forms part of these terms.

14. Changes to these terms

We may update these terms. The version published on this page when you accept a quotation is the version that applies to that project.

15. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Abu Dhabi. The courts of Abu Dhabi have jurisdiction over any dispute, without prejudice to any right you have to bring proceedings elsewhere where the law gives you that right.
